I have this tree planted in my west facing front yard and do not know what kind it is. I have been to Minter Gardens here in Chilliwack and asked Brian but he did not know it, hoping you can help, before I take it out. thanks

This looks like juvenile foliage from a Crataegus (hawthorn) species. It could be one of many. To make a positive identification, I would be interested to see leaves from a reproductive branch, or even better, the stem and fruits, along with the leaves, and some way to judge the scale (a ruler or quarter placed beside the shoot does nicely). The funny looking leafy bits at the base of the leaf stems are "stipules," which are generally more elaborated on rapidly growing juvenile tissue. Stipules are normally shed in the spring before the leaves mature.
