I am on the Plant Information Line and have been requested to identify this tree The information provided is as follows:

The tree seems to be a scrub looking tree, not sure. It is growing on the side of a hill under or beside other trees, cedar, maples etc. It has a smooth bark. No seeds or cones. The leaves are shiny and reasonably thick which makes me think it will not loose it leaves or at least not until very late in the winter. It looks to be about 15 to 20 ft high. Maybe not that high as I was standing lower than the tree. As you can see in the picture the leaves are opposite one another, about 3 leaves on each side of the stem and one at the end. The leaf is pointed and the edges are smooth.
Thanks for giving it a try.
