I wouldn't consider it to be a spicebush. I would consider it to be a holly, looks every bit like one of the eastern North American deciduous species.
Agree it looks rather like one of the deciduous hollies, but aren't the fruit peduncles a bit long for that? Hollies at least generally have very short fruit peduncles; that's what stopped me from saying a holly last night.
