What kind of tree is this? and are it's berries dangerous to fish?

    Now I have done it...
    I built a water garden under a neighbors tree and it is dumping a bunch of berries in my almost complete pond.
    Look at the pictures and tell me what you can about this type of tree and berry.

    Myoporum laetum (if there are translucent dots in the leaves)

    From UC Davis database: "Leaves and fruits are toxic and may be fatal to livestock. The toxin (ngaione) is a furanoid sesquiterpene ketone that constitutes 70 to 80 percent of oil of ngaio, an essential oil (Fuller and McClintock 1986). The fruit is less toxic than the leaves, and toxin is released with leaf fall (Salmon 1986).

    You can probably go next door and state the situation. Anyone with a sense of reason would agree to remove the tree, as it's dangerous. Is it possible that it's considered a noxious weed? If so your local council might agree to have it removed?
