Please help with a volunteer plant

    Both my neighbor and I have these plants that we think the birds were kind enough to plant for us but we don't know what they are, any ideas?

    the plant is about 12" high, has thin leaves and has not bloomed, leaves make a cross at each junction and are varigated with a white strip in the middle. If they are a flower my neighbor says I can have his but I'd like to know what they are before I take them.

    This is Euphorbia lathyris (caper spurge or mole plant), a poisonous, biennial "weed" of gardens. It is often mis-spelled E. lathyrus. See the following commercial link for some excellent images, but also see this Purdue University site for a comprehensive overview of the species.
