That'd be a huge cherry if it was one, but I don't think it is either (though I would need a better image of the leaves at a minimum to tell). If you can get that (and even better, a photo of the fruits), I'm sure we can identify it here. Since I'm guessing you are also concerned about safety, the typical process from a liability standpoint would be to bring in a consulting arborist. The International Society of Arboriculturists provides an online tool to find a certified arborist in your area: Find an Arborist . Look specifically for one with "ISA Tree Risk Assessment Qualification"
