What kind of tree is this? and are it's berries dangerous to fish?

Now I have done it...
I built a water garden under a neighbors tree and it is dumping a bunch of berries in my almost complete pond.
Look at the pictures and tell me what you can about this type of tree and berry.

Myoporum laetum (if there are translucent dots in the leaves)

 

looks almost like a Lilly Pilly

You can probably go next door and state the situation. Anyone with a sense of reason would agree to remove the tree, as it's dangerous. Is it possible that it's considered a noxious weed? If so your local council might agree to have it removed?
